My adjustment of status via marriage was denied. My marriage was falling apart right after the green card interview happened especially after I got laid off, my wife doesnt want to deal with me anymore (she is the U.S. citizen). I got a notice saying I-485 was denied although it says it was pending online!! anyways, I got accepted for a masters degree in a local school way before any of that happened. Now, can you please advise me whether I could go to the International Center of my school and get an I-20, then go back to my home country and get an F-1 Visa? Note that I am going to divorce my wife, so I am not doing this to bypass any laws or regulations, I am a professional engineer and to get an M.S. or MBA is important to get promoted especially in my field. Would you please help? I entered this marriage with good faith and i am so sorry that all she cared about is me taking care of her bills ;/. To have an M.S. is important also to get an H1B.

Yes, you can apply for your F-1 visa with the school. Sounds like you’ve been legally here the whole time. Good Luck!

Sounds like your screwed. Getting married seems to be what messed you up since it screwed up your status. I wouldnt apply for a h1b since it means your going to take a pay cut and probably wont have time to finish your degree since if you get fired, layed off or pass contract, you get deported.

You can apply for an F-1 visa at a U.S. visa office in your home country if you have a SEVIS form I-20, a valid passport, and sufficient funds to support yourself while you attend school full-time.
I’m sure that the visa officer will want a full explanation about your failed I-485 application, but you seem well prepared to provide him with the details.
